How disruption may impact on diversity in the legal profession

Tuesday 17 May 2016 from 12:30 to 14:30
Hyatt Regency Perth Grand Ballroom

In promoting diversity within the legal profession, lawyers are supporting a strong and fair profession comprising, accommodating, encouraging and respecting a diverse range of individuals and views.  This is occurring at the same time as disruption of the kind predicted by Richard Susskind gains momentum, allowing for opportunities in changing the way that legal services are delivered and transforming the way our courts work.  How will this disruption impact on diversity – and vice versa?

This FREE session will begin with a light networking lunch.

Concerned about the incidence and extent of "elder abuse" in Australia?

This third party event provides the opportunity for practitioners and other interested persons to hear from Professor Rosalind Croucher AM, President of the Australian Law Reform Commission, regarding:

  • the scale of elder abuse in Australia;
  • the scope and progress of the ALRC inquiry (more info below); and
  • the adequacy of existing federal legal responses and future developments.

About the ALRC Inquiry

In February 2016, the Commonwealth Attorney-General announced an inquiry into laws and frameworks to safeguard older Australians from abuse. The inquiry is being undertaken by the Australian Law Reform Commission. The inquiry will assist the federal government to identify the best way to protect older Australians, while at the same time promoting respect for their rights. It is anticipated that the inquiry will report in May 2017.

The inquiry was launched in the wake of several inquiries into elder abuse in various Australian states, and an inquiry into employment discrimination against older Australians. It has also been discussed at Victoria's Royal Commission into Family ViolenceThe ALRC inquiry will: ...scrutinise existing Commonwealth laws and frameworks which seek to safeguard and protect older persons from misuse or abuse by formal and informal carers, supporters, representatives and others. The inquiry will be broad in scope and consider regulation of areas of federal jurisdiction such as financial institutions, superannuation, social security, aged care and health.

As many laws affecting older people come within the purview of the states and territories - for example the regulation of powers of attorney, wills, and estates - the inquiry will also examine how federal laws interact with relevant state and territory laws. The outcomes of the inquiry promise to recalibrate legal approaches to elder abuse in Australia.
